Mold

Whether it’s a hole in a roof, a leaky pipe, a leaking air conditioner or other structural building damage that allows moisture to remain in an area, long-term exposure to this type of situation, coupled with Florida ’s humid climate, can cause mold to grow quickly and can make a person sick. It can also destroy your personal property.

Air quality testing and mold remediation can be expensive. Even if you do not have any health problems associated with your indoor air quality, it can cost thousands upon thousands of dollars to rid your home, office or condominium of mold. You may be entitled to insurance benefits to assist you in covering the cost of remediation. Likewise, you may have the right to recover these costs from a builder, a contractor or someone else. At Law Offices of Brad E. Kelsky, P.A., we aggressively evaluate these claims to determine whether you have recourse for the damage to your home, your office or your personal property as a result of mold. The following conditions are known to be associated with prolonged exposure to mold in “damp indoor environments”:

  1. Upper respiratory tract infections with symptoms including nasal congestion, rhinitis, allergic rhinitis, sneezing, runny or itchy nose, sinusitis and sore throat;
  2. Cough and lower respiratory infections with symptoms including cough, wheeze, chest tightness and shortness of breath;
  3. Asthma symptoms in persons already diagnosed with athsma; and
  4. Hypersensitivity pneumonitis, a lung disease with symptoms of dry cough, shortness of breath, fever, and sometimes acute bronchospasm due to inhaled antigens.

Current research suggests that there may also be a relationship between mold and the development of asthma and shortness of breath.

If you rent, lease, live in a condominium or work in a building and you believe that there is a problem with mold, you should know you have legal rights. At the Law Offices of Brad E. Kelsky, P.A., we will aggressively investigate your claim and, together, we can determine whether legal recourse is the right decision for you.
